Dairy Indemnity Program

U.S. Department of Agriculture > Dairy Indemnity Program

Program Description:

The Dairy Indemnity Program protects dairy farmers and manufacturers of dairy products who, through no fault of their own, are directed to remove their milk or dairy products from commercial markets because of contamination from pesticides which have been approved for use by the Federal government. Dairy farmers can also be indemnified because of contamination with chemicals or toxic substances, nuclear radiation or fallout.

General Program Requirements:

In order to qualify for this benefit program, you must be or have been a dairy farmer, rancher or agricultural producer/farmer whose dairy product has been removed from the market by a public agency.

Loan Terms:

Not Applicable

Application Process:

Affected producers and manufacturers should apply for indemnity payments at their USDA Service Centers or Farm Service Agency (FSA) offices. Applications must be filed no later than December 31 following the fiscal year in which the loss occurred.

The application period for Notice FSA-373 begins on the date the milk was officially removed from the market by public agency and ends on the date the milk was officially reinstated to the market by public agency. The application period may not extend past the end of a FY if the producer's milk is still quarantined from the market and losses from more than one FY cannot be included on one FSA-373.
